Privacy notice

This notice describes the processing of personal data when visiting www.mabels.at and submitting enquiries through this website. The relevant rules include the General Data Protection Regulation (GDPR), Austria’s Data Protection Act (DSG) and, where applicable, the Telecommunications Act 2021 (TKG 2021).

1. Controller and contact

The controller is LAX 90 Gastronomie Betriebges.m.b.H., Laxenburgerstraße 90, 1100 Vienna, Austria. Please send privacy enquiries to office@mabels.at or by post to this address. Telephone: +43 1 604 53 97.

2. Website access and hosting

Accessing the website involves processing technical connection data, including your IP address, access time and requested address, browser information and technical status or error details. The hosting configuration determines which of these details are additionally stored in server logs.

The purposes are delivering the website, maintaining reliability and security, and investigating technical faults or misuse. The legal basis is Article 6(1)(f) GDPR; our legitimate interest is a secure and reliable website. Hosting and IT service providers may process these data while providing their services to us.

3. Reservation form and email enquiries

For reservations we process your name, email address, requested date and time, party size and, if supplied voluntarily, telephone number and comments. The form sends these details to a PHP script on our server, which forwards the request by email to reservierung@mabels.at. A reservation is only confirmed once we have sent our confirmation by email.

We use the information to handle the enquiry, arrange and carry out the reservation and ask necessary follow-up questions. The legal basis is Article 6(1)(b) GDPR for steps prior to a contract and handling your reservation. Other enquiries are handled under Article 6(1)(f) GDPR; our interest is responding appropriately to your message.

Fields marked as required are needed to process requests through the form. Without them the form cannot be submitted. Telephone number and comments are optional. Please do not enter sensitive information, such as health data, in the comments field.

Recipients are staff handling requests and our hosting, email and, where applicable, IT service providers. Enquiries are not automatically used for newsletters or other marketing messages.

We retain data only while required to handle the enquiry and reservation. Where specific documents must be retained by law, further retention is based on Article 6(1)(c) GDPR. Evidence specifically required for legal claims may be kept longer under Article 6(1)(f) GDPR. Statutory exceptions do not replace routine deletion of other enquiries.

4. Cookies, tracking and automated decisions

Our own website code does not set cookies or store visitor identifiers in Local Storage or Session Storage. This code contains no analytics or advertising trackers. We do not carry out profiling of website visitors or solely automated decisions with legal or similarly significant effects.

5. Instagram photo strip

Our server retrieves posts from our Instagram account @mabelsno90 through the Instagram API and serves selected images, previews and descriptions through our own website. The photo strip does not use an Instagram iframe or Meta Pixel. This integration does not connect your browser directly to Instagram when loading these contents, and does not forward your visitor IP address to Meta.

Content is cached on our server and updated regularly. This cache is not a visitor analytics tool. Technical access data on our website are processed as described in section 2. The photo strip provides information about our venue.

Clicking a post or our profile takes you to Instagram, where the provider’s privacy rules apply. For EEA users the provider is Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland. Further information: Instagram privacy policy.

6. External links and directions

The website links to Facebook, Instagram and Google Maps. No interactive Google Maps map is embedded. Simply displaying these links does not load content from those providers. Opening a link takes you to the external website; its provider may receive your IP address and other technical information and use cookies under its own rules. Processing outside the EEA may occur.

Provider information: Facebook, Instagram and Google. This notice does not cover the providers’ independent processing on those websites.

7. Fonts

This legal notice and privacy page uses fonts already available on your device and does not download fonts from Google.

Our main website serves DM Sans and Playfair Display locally from our own web server. Displaying these fonts does not connect your browser to Google Fonts.

8. Recipients, security and international transfers

Personal data are processed for the purposes described in this notice. Data may be disclosed to competent authorities where legally required.

We implement technical and organisational measures appropriate to the risk. The form should only be used over HTTPS. Forwarding and responding by email is not end-to-end encrypted communication.

9. Your rights

Subject to the applicable legal conditions, you have rights of access, rectification, erasure, restriction and data portability. Where processing is based on consent, you may withdraw it at any time for the future without affecting the lawfulness of processing before withdrawal.

Objecting to processing based on legitimate interests

You may object at any time, for reasons relating to your particular situation, to processing based on Article 6(1)(f) GDPR. We then assess whether to stop processing or whether compelling legitimate grounds or legal claims justify continuing.

To exercise your rights, contact office@mabels.at. We normally respond within one month and inform you of any legally permitted extension. If there are reasonable doubts about your identity, we may request additional information necessary to verify it.

You may lodge a complaint with a data protection supervisory authority. In Austria: Austrian Data Protection Authority, Barichgasse 40–42, 1030 Vienna; email: dsb@dsb.gv.at; website: www.dsb.gv.at.

10. Scope and changes

This notice covers the website functions described above and enquiries received through them. Other business processing, such as job applications or event photography, may require separate privacy information. We update this notice when technology or processing changes.
